Terms of Service

What changed in version 2. The Vizzie service is now provided by Vizzie Trading Pty Ltd (ACN 701 787 902) rather than Vizzie Studio Pty Ltd. Your agreement is with Vizzie Trading Pty Ltd from the date you accept this version. Nothing else in these terms has changed.
These terms are an agreement between you and Vizzie Trading Pty Ltd (ACN 701 787 902), trading as Vizzie ("we", "us"), governing your use of the Vizzie application at app.vizzie.org, the Vizzie website, and related services (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
1The Service, and beta status
Vizzie helps you turn public open data into maps, charts, and tables, and share them. The Service is currently in beta: features may change, be limited, or be withdrawn; it may contain errors; and it may be unavailable from time to time. We provide it without any guarantee of availability, and we may impose usage limits (for example, on projects, connected datasets, or storage).
2Open data & accuracy — please read
Vizzie surfaces datasets published by third-party open-data providers (government portals, agencies, and other publishers). We do not create, own, verify, or control that data.
Data-accuracy disclaimer
Open data may be inaccurate, incomplete, out of date, or wrong. All data, maps, charts, and results in the Service are provided "as is" and for general information only, without any warranty of accuracy, completeness, currency, or fitness for a particular purpose. Do not rely on Vizzie for any official, legal, financial, medical, safety, navigational, emergency, or other decision-making purpose. Always verify against the authoritative original source before acting. To the fullest extent permitted by law, we are not liable for any decision made, or action taken, in reliance on the data.
3Source licences & your responsibilities
Each dataset is made available by its publisher under its own licence and terms, which may require attribution and may restrict how the data can be used, shared, or combined. Where we can determine a source and licence, we display attribution to help you — but you are responsible for complying with the licence and terms that apply to any data you view, export, publish, or otherwise use, including giving required attribution and observing any restrictions (for example non-commercial or share-alike conditions). If you are unsure of your rights to use a dataset, do not publish or redistribute it.
4Your account
- You must provide accurate information and keep your login details secure.
- You are responsible for activity under your account.
- The Service is not directed to children under 13.
5Acceptable use
You agree not to:
- use the Service unlawfully, or to infringe anyone's rights;
- upload or map personal data you have no right to use, or publish content that is unlawful, infringing, or harmful;
- attempt to disrupt, overload, probe, or gain unauthorised access to the Service, its infrastructure, or the third-party portals it connects to;
- use the Service to build a competing dataset by systematic bulk extraction, or otherwise abuse connected portals' rate limits or terms.
6Your content, and publishing
You keep the rights in the projects and content you create. You grant us a licence to host and process that content as needed to run the Service. When you publish or share a map, the underlying data may be included in the shareable link — you are responsible for what you choose to publish and for ensuring you have the right to share it. Do not publish personal or sensitive data without a lawful basis.
7Intellectual property
The Vizzie software, design, and brand are owned by us, or are licensed to us by a related company. These terms do not grant you any right in them except to use the Service as intended.
8Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to availability, accuracy, reliability, or fitness for a particular purpose, to the fullest extent permitted by law.
9Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Service or the data within it.
Our total liability to you for all claims arising out of or in connection with the Service is limited to the greater of (a) the fees you paid us in the 12 months before the claim arose, and (b) AU$100.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term implied or imposed by law, that cannot lawfully be excluded — including the consumer guarantees under the Australian Consumer Law. Where our liability under a consumer guarantee may be limited, our liability is limited (at our option) to resupplying the Service or paying the cost of having it resupplied.
10Indemnity
You agree to indemnify us against claims arising from your misuse of the Service, the content you publish, or your breach of these terms or of a source dataset's licence.
11Suspension & termination
We may suspend or terminate access if you breach these terms or to protect the Service or others. You may stop using the Service at any time and delete your account and data — see Data Deletion.
12Paid plans, billing & refunds
Vizzie is free while it is in beta. We do not currently offer paid plans, and this section has no effect until we do. It is published now so that the terms are settled before any charge is ever made, not written after the fact.
When paid plans are offered:
- Who you pay. Payments are handled by a third-party merchant of record, identified at checkout. They are the seller for the transaction, issue your invoice, and collect any GST, VAT or sales tax that applies where you are.
- Renewal. Subscriptions renew automatically for the same period at the then-current price until you cancel.
- Cancelling. You can cancel at any time. Your paid features continue until the end of the period you have already paid for, and we do not refund the unused part of that period.
- Refunds. If Vizzie is not what you needed, email us within 14 days of your first payment on a plan and we will refund it in full. Beyond that, refunds are at our discretion — separately from, and without limiting, your rights below.
- Price changes. We will give you at least 30 days' notice before a price change applies to your renewal. If you do not want the new price, cancel before it takes effect.
- Non-payment. If a payment fails and is not resolved, the account returns to the free tier. Your projects are not deleted because of non-payment — see Privacy Policy for how long we keep data.
None of this limits your rights under the Australian Consumer Law or any equivalent law where you live, including the right to a refund where a service fails to meet a consumer guarantee.
13Changes
We may update the Service and these terms. Material changes will be shown by the "last updated" date above; continuing to use the Service means you accept the updated terms.
14Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria (and the courts able to hear appeals from them) have exclusive jurisdiction, except where mandatory local law provides otherwise.
